Scalia was the most entertaining Justice by far. The cases I watched weren’t too interesting, which he mentioned But he’s clearly not a textualist, or really into the Constitution. He’s a Republican lawyer with a lot of power, willing to word salad to push the Party line. George W. Bush had tortured a lot of people after 911. Torture is internationally banned for a reason.
But yes torture is clearly prohibited by the Eighth amendment, as the Founders clearly wished it to be.
